Unless otherwise stated, all prices include New Zealand Goods and Services Tax
(GST) of 12.5%. Prices, specifications and availability are subject to change
without notice.
If an item is not yet available when you order, we will let you know the manufacturers
expect release date. You may withdraw your order if you do not wish to wait.
Certain goods may be at the end of a line or have limited time available for
purchase. Techweld NZ Ltd cannot guarantee products will always be available
when you place your order. All specials and promotions are limited to stock
on hand or items ordered within a specified time frame.
Payment and Title
Payment for online orders shall be made by credit card only (Visa &
MasterCard). Payment for telephone orders may be made by credit card, direct
credit or cleared cheque prior to dispatch of goods.
Should payment for supply of goods or services be outside of, or beyond, our
payment terms you will be liable for all costs, fees, damages, and expenses
including legal costs (on a full indemnity basis) and all other fees incurred
by us in recovering the amount outstanding. Ownership of the goods remains with
Techweld NZ Ltd and does not pass to you until we receive all amounts you owe
to us.
Delivery
Dispatch and Delivery shall be in accordance with our Delivery Policy.
Force Majeure
Should Techweld NZ Ltd be delayed in or prevented from making delivery owing
to any cause whatsoever beyond Techweld NZ Ltd’s control, then Techweld
NZ Ltd shall be at liberty to cancel or suspend the order without incurring
liability for any loss or damage resulting therefrom.
Safety Operating Instructions
The owner’s/operator’s safety is Techweld NZ Ltd’s primary
concern. The customer shall be required to agree, prior to purchase, to read
and follow the safe operating instructions of equipment purchased from Techweld
NZ Ltd, and where relevant, equipment that it is to be used in conjunction with.
Warranties
The manufacturers warranty starts from the date of sale. The terms of warranty
cover defective workmanship or materials. In the event there is a need to make
a claim, the goods shall be returned to Techweld NZ Ltd, in original condition,
for inspection. The customer shall be responsible for the cost of returning
the product. Should the problem be a legitimate claim, the product will be repaired
and returned freight free. Techweld NZ Ltd will have sole discretion to repair
or replace the goods.
Returns
The customer shall meet any costs incurred for the return of goods. If a return
is a service requirement, the customer shall meet the cost of repair and any
freight charges prior to the return of the product.
Privacy Policy
Techweld NZ Ltd respects your privacy. We do not use cookies or any other mechanism
to capture or maintain information from users without their consent. The only
personal information we capture has been specifically submitted to us through
forms clearly identified for that purpose.
Where we do ask you to provide personal information (such as name, e-mail address,
and telephone number), this information will be used solely for the purpose
stated, or to contact you with relevant information. If you wish to remove or
change your information held by us, we will promptly take action to comply with
your request.
Copyright
This website and Trademarks, Patents and associated content and material owned
by Techweld NZ Ltd is protected by copyright. Unauthorised use of any content
is strictly prohibited and may infringe on intellectual property rights held
by Techweld NZ Ltd. Copyright of some material may be held by the suppliers
of Techweld NZ Ltd, in which case the suppliers retain all rights.
Consumer Guarantees Act
If you are purchasing or holding yourself out as purchasing the Products for
a business purpose, then the provisions of the Consumer Guarantees Act 1993
(New Zealand) are excluded from any supply agreement and to the extent permitted
by law, all statutory or implied conditions, warranties and guarantees which
would apply are expressly excluded.
Waiver
If we fail to enforce any terms or to exercise our rights under these terms
and conditions at any time, we have not waived those rights.
Severability
If in the event that any part of these terms and conditions will be determined
to be invalid, unlawful, or unenforceable for any reason, such terms and conditions
will be severed from the remaining terms and conditions which will be valid
and enforceable to the fullest extent permitted by law.
Governing Law
The use of this website and these Terms and Conditions shall be governed by
the Laws of New Zealand. Any legal action arising out of its use shall be brought
and enforced under the Laws of New Zealand shall be within the exclusive jurisdiction
of New Zealand.
Changes to Terms and Conditions
We reserve the right to alter these Terms and Conditions at any time and without
notice.
